You may revoke your contractual declaration within 14 days without stating any reasons in text form (e.g. letter, fax, e-mail) or—if the goods are delivered to you before the expiry of the deadline—by returning the goods.
The withdrawal period begins upon receipt of this notice in text form, but not before the goods have been received by the recipient (in the case of recurring deliveries of similar goods, not before receipt of the first partial delivery), and also not before we have fulfilled our information obligations pursuant to Article 246 § 2 in conjunction with § 1 paragraphs 1 and 2 EGBGB as well as our obligations pursuant to § 312 e paragraph 1 sentence 1 BGB in conjunction with Article 246 § 3 EGBGB.

In the event of an effective withdrawal, both parties must return any received benefits and surrender any derived advantages (e.g. interest), if applicable. If you are unable to return the received goods or services in whole or in part, or only in a deteriorated condition, you may be required to compensate us for the loss in value. This does not apply to the surrender of goods if the deterioration of the goods is solely due to their inspection, as would have been possible in a retail store. You are not required to pay compensation for any deterioration resulting from the intended use of the goods.
Goods that can be sent by parcel must be returned at our risk. You must bear the costs of returning the goods if the delivered goods correspond to those ordered and if the price of the goods being returned does not exceed 40 euros, or if, in the case of a higher price of the goods, you have not yet provided the consideration or a contractually agreed partial payment at the time of withdrawal. Otherwise, the return shipment is free of charge for you. Goods that cannot be sent by parcel will be collected from you. Obligations to refund payments must be fulfilled within 30 days. § 1 Scope
For business relationships between us as the provider and the customer, the following General Terms and Conditions apply to orders placed via the website of PowerBox-Systems GmbH in the version valid at the time of the order.
§ 2 Conclusion of Contract
The presentation of our products at PowerBox-Systems GmbH merely constitutes an invitation to the customer to submit a contractual offer. By sending an order via the website of PowerBox-Systems GmbH, the customer submits an offer within the meaning of § 145 BGB to conclude a contract. After submitting the order, the customer will first receive an order confirmation acknowledging receipt.
The contract between us and the customer is only concluded when the customer receives a shipping confirmation in text form for the ordered goods within 10 days after submitting the order.
§ 3 Allocation of Return Costs in Case of Exercising the Right of Withdrawal for Consumers
You must bear the costs of returning the goods if the delivered goods correspond to those ordered and if the price of the goods being returned does not exceed 40.00 euros, or if, in the case of a higher price of the goods, you have not yet provided the consideration or a contractually agreed partial payment at the time of withdrawal. Otherwise, the return shipment is free of charge for you.
§ 4 Delivery, Shipping Costs, Transfer of Risk
Delivery shall be made at the shipping costs specified in each individual case. If the customer is a consumer, we bear the shipping risk in any case regardless of the shipping method. If the customer is an entrepreneur, all risks and dangers of shipment pass to the customer as soon as the goods have been handed over by us to the commissioned logistics partner.
§ 5 Retention of Title
The delivered goods remain our property until full payment of the purchase price has been made.
§ 6 Payments
Only the payment methods displayed to the customer during the ordering process will be accepted.
§ 7 Warranty
Warranty claims are governed by the statutory provisions of the German Civil Code (BGB). If the purchase is a commercial transaction for both parties, the provisions of the German Commercial Code (HGB) remain unaffected.
§ 8 Information for Consumers in Distance Contracts and Customer Information in Electronic Commerce
a) We are not subject to any specific codes of conduct not mentioned above.
b) Any input errors made when placing your order can be recognized during the ordering process before submitting the order and corrected using the correction function before submitting the order.
c) The essential characteristics of the products offered by us and, where applicable, the validity period of limited offers can be found in the individual product descriptions within our offer.
d) The language available for the conclusion of the contract is exclusively German.
e) Complaints and warranty claims can be submitted to the address specified in the provider identification.
f) You can save the contract text on your computer by right-clicking and using your browser’s save function, or print it using your browser’s print function. The contract text is not accessible to you otherwise. You can also view the details of your order via your user account under the section “Where is my order?”. The contract text will also be stored by us.
g) For information regarding payment, delivery, or fulfillment, please refer to the specific product offer.
§ 9 Miscellaneous
a) The law of the Federal Republic of Germany shall apply to the contractual relationship between us and the customer as well as to the respective terms and conditions. If the customer is a consumer, the mandatory statutory provisions and rights of the country of residence of the consumer that are favorable to the consumer remain unaffected by this agreement. The application of the UN Convention on Contracts for the International Sale of Goods (CISG) is excluded.
b) The exclusive place of jurisdiction is the court at our place of business if the customer is a merchant within the meaning of the German Commercial Code (HGB) or a legal entity under public law. In this case, we are also entitled to bring an action at the customer’s place of business.
§ 10 Severability Clause
Should individual provisions of this contract be wholly or partially legally ineffective or later lose their legal validity, the validity of the remainder of the contract shall remain unaffected.
